in the high court of judicature at patna criminal miscellaneous no.3503 of 2012 ====================================================== tipu singh @ bichho singh @ bichho .... .... petitioner/s versus the state of bihar .... .... opposite party/s ====================================================== coram: honourable mr. justice aditya kumar trivedi oral order (per: honourable mr. justice aditya kumar trivedi”24. 01.2012 heard learned counsel for the petitioner as well as learned additional p.p. in the background of earlier case which was registered against other co-accused for committing murderous attack upon rakesh kumar and during course of which the fir named accused were deprived of their pistol which was subsequently deposited at the p.s., it has been alleged that on 29.07.2011 while he was sleeping at his house, the miscreants took him to orchard where four persons were present since before out of whom he identified chandan kumar and raushan kumar who had demanded rs.1,50,000/-, as a price of the pistol. he undertook to pay the same. contention on behalf of the petitioner is that petitioner being a co-villager of the informant must have been identified at his presence during course of commission of crime. further submitted that petitioner is not named in the fir. the order impugned also suggest that there happens to patna high court cr.misc. no.3503 of 2012 (2) dt.24-01-2012 2 be no specific allegation attributed against him. in the aforesaid facts and circumstances of the case, petitioner, tipu singh @ bichho singh @ bichho is directed to be released on bail on furnishing bail bonds of rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned sri rajeev narayan, judicial magistrate, 1st class, lakhisarai in connection with barhaiya p.s. case no.81 of 2011.
