IN THE HIGH COURT OF JUDICATURE AT PATNA Criminal Miscellaneous No.39271 of 2011 Hareram Prasad & Ors Versus The State Of Bihar ---------------------------------- with Criminal Miscellaneous No.36630 of 2011 Shiv Bihari Prasad & Ors Versus The State Of Bihar ----------- 03/ 24.01.2012 Both the above stated petitions arise out of Nawanagar P.S. Case no. 104/2011 initially, registered under sections 307 and other minor sections of the IPC but later on, section 302 of the IPC was also added and accordingly, both the above stated petitions are being disposed off by this common order. Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State assisted by learned counsel for the informant. Petitioners are named in the first information report and omnibus allegation of assault has been levelled against them. It would appear from perusal of the first information report that it was co-accused Ramchandra Bind who gave farsa blow to the deceased Lutan Singh. Admittedly, having more or less similar allegation some co accused persons have already been granted privilege of bail. Accordingly, petitioners, Harendra Prasad, Umesh Prasad, Sheo Sagar Prasad, Shiv Bihari Prasad, Bihari Prasad and Taklu Prasad & Dharmendr @ Lalku Pd, be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount -2- each to the satisfaction of the Chief Judicial Magistrate, Buxar in Nawanagar P.S.
