24. 01-2012 Heard learned counsels for the petitioners and the State. The petitioners being elder brother of husband and wife of brother of husband are apprehending their arrest in a case registered under Sections 498A and 302/34 of the Indian Penal Code. It is alleged that informant gave birth of a male child which was subsequently been killed by in-laws family. It is submitted by learned counsel for the petitioners that the victim gave a dead male child and on suspicion the accusation has been made. From the F.I.R. itself, it appears that the informant on receiving information from the mother-in-law that she gave a dead male child got suspicion and has lodged a case. It is further submitted that the petitioners are separate from Patna High Court Cr.Misc. No.2270 of 2012 (2) dt.24-01-2012 the husbands family. Considering the suspicious nature of accusation, let the petitioners, Renu Devi, Ramrati Devi @ Ramwati Devi @ Ramwati Mandal, Ramrit Mandal and Ram Sevak Kumar Mandal @ Ram Sevak Mandal, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Marouna P.S. Case No. 33/10, G.R. No. 819/10 on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M. Supaul, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Dinesh Kumar Singh, J.) U.K./-
