IN THE HIGH COURT OF JUDICATURE AT PATNA Criminal Miscellaneous No.1241 of 2012 Sanpato Devi @ Sampato Devi & Ors. Versus The State Of Bihar 2. 16.01.2012. Heard Mr. Vikram Deo Singh, learned senior counsel for the petitioner and Dr. Indiwar Kumari, learned A.P.P. for the State. The petitioner being the wife, brothers, uncle of husband are apprehending their arrest in a case registered under Sections 304(B) and 201/34 of the Indian Penal Code. The accusation is of demand of dowry and torture. Learned counsel for the petitioner submits that charge sheet has been submitted under Section 309 of the Indian Penal Code when the cognizance has been taken under Section 306 of the I.P.C. Considering the aforesaid facts, let the petitioners, Sanpato Devi @ Sampato Devi, Pappu Kumar @ Pappu Singh, Manoj Kumar @ Manoj Singh, Raman Singh @ Ramanand Singh and Raju Singh, be released on bail in the event of arrest or surrender before the learned court below within a period of 2 twelve weeks from today in connection with Karakat P.S. Case No. 158 of 2010 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Bikramganj, District- Rohtas at Sasaram, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
