patna high court cr.misc. no.780 of 2012 (2) dt.17-01-2012 in the high court of judicature at patna criminal miscellaneous no.780 of 2012 ====================================================== shiv narain paswan .... .... petitioner. versus the state of bihar .... .... opposite party. ====================================================== appearance : for the petitioner : mr. ashok kumar malik, advocate. for the opposite party : mr. arun kumar pandey, a.p.p. ====================================================== coram: honourable mr. justice dinesh kumar singh oral order (per: honourable mr. justice dinesh kumar singh”17. 01-2012 heard learned counsels for the petitioner and the state. the petitioner is languishing in custody since 06.09.2011 in a case registered for the offence under sections 22 and 23 of the narcotic drugs and psychotropic substances act. 4 kg. of heroin was recovered from the roof top of magic van. subsequently it was found that the petitioner was travelling in the said vehicle and with the help of sniffer dog the suspicion was raised against the petitioner. the statement has been made in the petition that the petitioner has no criminal antecedent. considering the suspicious nature of accusation, let the petitioner above named be released on bail on furnishing bail bond of rs. patna high court cr.misc. no.780 of 2012 (2) dt.17-01-2012 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned sessions judge-cum-special judge, purnea, in connection with special case no. 15 of 2011 arising out of jogbani (bathnaha)p.s. case no. 80 of 2011. learned court below will be at liberty to cancel the bail of the petitioner if the petitioner defaults for three consecutive occasions during trial or he gets involved in similar nature of offence.
