17. h April 2013 HON'BLE THE CHIEF JUSTICE MR AMITAVA ROY HON'BLE MR JUSTICE V.K. MATHUR Mr Kailash Jangid, for the petitioners Mr G.R. Punia, Additional Advocate General, for the caveator-respondent State Heard Mr Kailash Jangid for the petitioners and learned Additional Advocate General Mr G.R. Punia for the respondents. Issue notice, returnable on 29th April 2013. As learned Additional Advocate General Mr G.R. Punia has entered appearance on behalf of all the respondents, no formal notice be issued to them. Learned counsel for the petitioners would serve adequate number of copies of the writ petition along with annexures to Mr Punia, appearing on behalf of the respondents. Heard the learned counsel for the parties on the prayer for interim relief. It is submitted at the Bar that this prayer has already been examined by a coordinate Bench of this Court in a batch of writ petitions, the lead case being D.B. Civil Writ Petition No.3276/2013, in which on 05th April 2013 following interim order has been passed: The experience certificate enclosed with the applications of petitioners, on the basis of direct appointment or through placement agency and in case where experience certificate is not available, then same will be considered, on the basis of appointment order of the petitioners, in Panchayati Raj Department or in any other scheme of the Panchayati Raj D.B. C.W.P. No.4089/2013 2/2 Department, the bonus marks as per notification dated 01st February 2013 will be awarded to petitioners, on provisional basis and the same will be taken into consideration while preparing final merit list of all the candidates. However, result/merit number of the petitioners will not be declared and the same will be kept in sealed cover, till final disposal of these writ petitions. It is made clear that this interim order will not create any right in favour of the petitioners. The persons, other than petitioners, out of the merit list may be given appointment, as per their merit, by the respondents in accordance with the Rules/law. After hearing learned counsel for the parties and noticing the identicalness of the issues involved, we are inclined to, without prejudice to the rights of the parties and until further orders, issue the same directions. The stay petition is disposed of accordingly. [V.K. MATHUR], J.
