The specific allegation of causing injury by lathi resulting into death of Nagina Bhagat, father of the informant, is against co-accused Kapildeo Bhagat. Another co-accused Jitendra Bhagat, whose case is identical to that of the petitioner, has already been granted bail by order dated 20.12.2011 passed in Cr. Misc. No. 41764 of 2011. Considering the facts and circumstances of the case, the petitioner is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Patna High Court Cr.Misc.
