22. 06/2012. PRESENT HON'BLE MR. JUSTICE SANGEET LODHA, V.J.

Mr. M.K. Garg, for the applicants. Mr. Ashok Prajapat, PP for the State. -- 1. Heard learned counsel for the applicants and the learned Public Prosecutor and also perused the material available on record.

2. An FIR (89/2012) has been registered inter-alia against the applicants herein for commission of offences under Sections 307, 323, 341, 447, 147, 148 and 149 of IPC at Police Station- Kesharisinghpur.

3. Learned counsel for the applicants submits the co- accused persons, namely, Jarnail Singh, Tara Singh and Roop Singh @ Roopvasant have already been enlarged on bail vide order dated 14.06.2012 passed by a Coordinate Bench in S.B. Criminal Misc. Bail Application No.4155/2012. It is submitted that the case against the present accused applicants is not distinguishable from the case of co-accused persons, who have been enlarged on bail by this Court. 2 o”

4. Learned Public Prosecutor opposed the bail application, however, he has not disputed that the case against the applicants is not distinguishable from the case as against the co-accused persons, who have already been enlarged on bail by this Court.

5. Having regard to the nature of accusation and taking into consideration totality of the facts and circumstances of the case, without expressing any opinion on the merits of the case, I deem it just and proper to enlarge the accused applicants on bail.

6. Accordingly, this bail application filed under Sec.439 Cr.P.C. is allowed and it is directed that applicants, (1) Gurdeep Singh S/o Surain Singh, (2) Karnail Singh S/o Gurdeep Singh and (3) Ajaib Singh S/o Resham Singh, shall be released on bail in connection with FIR No.89/2012 of Police Station-Keshrisinghpur provided each of them executes a personal bond for a sum of Rs.20,000/- with two sound and solvent sureties of Rs.10,000/- each to the satisfaction of learned trial court for their appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
