The present petitioner by way of filing this writ petition under Article 227 of the Constitution of India has prayed for quashing the order dated 29.5.2013 passed by the Principal District Judge, Garhwa in Misc Case Appeal No.14/2012 whereby the learned court below has dismissed the said appeal and confirmed the order dated 10.10.2012 passed in Misc.Case No. 7 of 2012which was filed in Execution Case No. 3/04 arising out of eviction suit no. 58 of 1988 whereby objection under order 21 Rule 97 CPC filed by the petitioner has been held not maintainable. Upon hearing the learned counsel for the petitioner and on perusal of the impugned order as well as the materials placed on record let urgent show cause notice be issued to respondents under registered cover with A/D as well as by ordinary process for which requisite etc. must be filed within one week. Notice returnable after four weeks Put up this case after four weeks. Till next date of listing status quo as existing today shall be maintained in respect of the order dated 29.5.2013 passed by the learned Principal District Judge,Garhwa in Misc. Appeal No.14/201.
