in the high court of jharkhand at ranchi a. b.a. no. 2175 of 2013 ajay singh .........petitioner vs. the state of jharkhand & anr ........opposite parties coram: hon'ble mr. justice prashant kumar for the petitioner: mr. p.k. mukhopadhyay for the state: mr. vijay kumar gupta, app 2/20.06.2013: anticipatory bail application filed by petitioner ajay singh is moved by sri p.k. mukhopadhyay and opposed by sri vijay kumar gupta, learned additional p.p. this is a case under section 498 a of the ipc. petitioner is husband. it appears that the present complaint case filed on 22.12.2009. it is submitted that on that date , it self, matrimonial suit bearing matrimonial suit no. 573 of 2009 was filed by the complainant ( rani singh) for divorce. the said matrimonial suit allowed vide order dated 25.2.2011,as contained in annexure-3 to this application . it it appears that at present, the marriage between the petitioner and complainant has already been dissolved. considering the aforesaid facts and circumstance, i allow this application and direct the petitioner to surrender in the court below by 01.07.2013 and in that event the court below is directed to enlarge the petitioner, above named, on bail on furnishing bail bond of rs. 10,000/- ( ten thousand) with two sureties of the like amount each to the satisfaction of learned judicial magistrate, 1st class, dhanbad in connection with c.p. case no. 2287 of 2009 , subject to the condition as laid down under section 438(2) of the cr.p.c. ( prashant kumar,j.) sharda/-

JUSTICE PRASHANT KUMAR For the Petitioner: Mr. P.K. Mukhopadhyay For the State: Mr. Vijay Kumar Gupta, APP 2/20.06.2013: Anticipatory bail application filed by petitioner Ajay Singh is moved by Sri P.K. Mukhopadhyay and opposed by Sri Vijay Kumar Gupta, learned Additional P.P. This is a case under section 498 A of the IPC. Petitioner is husband. It appears that the present complaint case filed on 22.12.2009.
