It is alleged that petitioners, who are President and Secretary of Taljhari Lamps had misappropriated 630.05 quintals of Paddy. It is submitted by learned counsel for the petitioners that the said paddy is still lying in the godown of Taljhari Lamps and key of the said godown is with the petitioners. It is further submitted that informant, without making any physical verification, has lodged present First Information Report. Under the said circumstance, I direct to Superintendent of Police, Sahebganj to make physical verification of the said godown personally, in presence of petitioners and report this Court as to whether 630.05 quintals of paddy is still lying in the godown or not. The Superintendent of Police is directed to file the said report by 02.07.2013. In the meantime, petitioners shall not be arrested in connection with Taljhari P.S. case no.02/13, corresponding to G.R. No. 14/13, pending in the court of Judicial Magistrate, 1st Class, Rajmahal. Let a copy of this order be handed over to Smt. Anita Sinha, Addl.P.P. for its onward communication to Superintendent of Police, Sahebganj. ( Prashant Kumar, J.) Pramanik/
