This application under Section 439 of the Cr. P. C. has been taken out by Hanif Chowdhury, an accused praying for bail in connection with Khanakul Police Station Case No.12 of 2012 dated 6.1.2012 under Sections 323/324/325/379/380/384/504/506(2) of

the I.P.C. Heard Mr. Ray, learned Counsel appearing on behalf of the petitioner. Heard Mrs. Patel, learned Counsel appearing on behalf of the State of West Bengal/opposite party who opposes the prayer for bail. Perused the C.D. and the materials therein.

On perusal of the C.D. and the annexures to the application, it appears to me that there are cases and counter cases between the two families and in this case, investigation is concluded on filing of the charge sheet. The accused/petitioner is in custody for quite a long period. His detention in custody for the purpose of investigation is not required. Accordingly, I allow the prayer for bail.
