Full Judgment

HON'BLE Mr. GEORGE PARACKEN, JUDICIAL MEMBER

The grievance of the applicant is that whereas the respondents have relaxed the educational qualification of employees working in BSNL for the examination for recruitment by promotion to the post of Junior Accounts Officer against the 40% quota earmarked for the employees working in BSNL, they have refused to relax the educational qualification of Senior Accountants working in BSNL for the examination for recruitment by promotion to the post of Junior Accounts Officer against the 10% quota earmarked for Senior Accountants working in BSNL. The aforesaid examination is scheduled to be held on 7.11.2009.

2. Before approaching this Tribunal the applicant has made Annexure A-4 representation dated 28.8.2009 to the Chairman and Managing Director, BSNL Corporate Office, New Delhi requesting to consider the case of Senior Accountants/Junior Accountants for 10% quota examination to JAO and relax the minimum qualification to +2/Higher Secondary. The aforesaid Annexure A-4 representation is yet to be disposed of.

3. We have heard Shri. R. Krishna Raj for the applicant and Shri. N. Nagaresh for the respondents. In our considered view this OA can be disposed of at the admission stage itself without calling for the reply from the respondents. We, therefore, direct the Chairman and Managing Director, BSNL Corporate Office, New Delhi to consider the Annexure A-4 representation of the applicant dated 28.8.2009 and dispose of it with a reasoned and speaking order under intimation to him within a period of two months from the date of receipt of a copy of this order. In the meanwhile, since the examination for recruitment of Junior Accounts Officers in BSNL against the 10% internal examination is scheduled to be held on 7.11.2009, the applicant is provisionally allowed to appear in the examination. If the applicant passes the examination, his appointment shall be subject to the decision of the Chairman and Managing Director, BSNL Corporate Office, New Delhi, conveyed to him in response to his Annexure A-4 representation.

4. The respondents No.1and2 shall ensure that this order is brought to the notice of the Chairman and Managing Director, BSNL as soon as possible as he is not a party in this Original Application.

5. With the aforesaid direction this OA is disposed of. There shall be no order as to costs.
