dr. k.b.s. rajan, judicial member1. two of the applicants in this original application are stated to have already qualified in the 2010 examination and are undergoing training. in so far as the other applicants are concerned on the basis of an interim order dated 12.10.2011 they were permitted to participate in the examination held by the department in the recent past. their results are awaited.2. in their counsel statement the respondents in paragraph 6 stated as under:-"6. it is submitted that the respondents have complied with the directions of the hon'ble tribunal as directed in oa 803/10 and also the reliefs sought in the present oa. therefore, it is submitted that the grievance in the instant oa stands redressed and hence, it is most humbly prayed before the hon'ble tribunal that oa may be closed. the above counsel statement is filed on the basis of the brief instructions furnished by the department, reserving the right of the department to file a detailed reply statement if found necessary in the course of the hearing of the matter, at a later stage."3. the request by the respondents is to close the oa is on account of the applicants having been permitted to participate in the examination. we take it that the respondents are satisfied that the applicants are entitled to participate in the examination as we have been given to understand that even those who did not approach the tribunal have been permitted to participate in the examination. 4. taking judicial note of the above, this oa is closed. the results of the examination be declared and acted upon. no order as to costs.

DR. K.B.S. RAJAN, JUDICIAL MEMBER

1. Two of the applicants in this Original Application are stated to have already qualified in the 2010 examination and are undergoing training. In so far as the other applicants are concerned on the basis of an interim order dated 12.10.2011 they were permitted to participate in the examination held by the department in the recent past. Their results are awaited.

2. In their counsel statement the respondents in paragraph 6 stated as under:-

"6. It is submitted that the respondents have complied with the directions of the Hon'ble Tribunal as directed in OA 803/10 and also the reliefs sought in the present OA. Therefore, it is submitted that the grievance in the instant OA stands redressed and hence, it is most humbly prayed before the Hon'ble Tribunal that OA may be closed. The above counsel statement is filed on the basis of the brief instructions furnished by the department, reserving the right of the department to file a detailed reply statement if found necessary in the course of the hearing of the matter, at a later stage."

3. The request by the respondents is to close the OA is on account of the applicants having been permitted to participate in the examination.
