Judgment:
Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorari, call for the records relating to proceedings of the second respondent in Na.Ka.No.922/2012/A.1 dated 20.3.2012 and quash the same.
O R D E R
1. Writ Petition is filed praying to issue a Writ of Certiorari, call for the records relating to proceedings of the second respondent in Na.Ka.No.922/2012/A.1 dated 20.3.2012 and quash the same.
2. Ms.V.M.Velumani, learned Special Government Pleader takes notice on behalf of the respondents. By consent, the writ petition is taken up for disposal.
3. The impugned proceedings is a notice issued by the second respondent directing the petitioner to stop the offending business of gunny bag stating that the public have given their grievances against the conduct of the business of the petitioner. Since the impugned proceeding has been issued in the nature of notice, petitioner is directed to give a detailed representation/reply to the second respondent. The second respondent shall decide the matter after affording personal hearing to the petitioner. If there is any specific complaint given by public or third party, a copy of the same shall also be furnished to the petitioner so as to enable the petitioner to submit his reply to the same. The authority shall pass a final order in accordance with law thereafter. The authority is directed to furnish the copies of complaints received from public or third parties to the petitioner within a period of one week from the date of receipt of a copy of this order. On receipt of the same, petitioner is directed to give his reply to the authority within a period of one week. The authority shall decide the matter within a period of one week thereafter.
4. The writ petition is disposed of accordingly. No costs. Consequently, connected miscellaneous petition is closed.
