Writ Petition is filed under Article 226 of Constitution of India praying to issue a Writ of Mandamus, directing the first respondent to consider the representation dated 25.4.2012 made by the petitioner prior to issuing orders to energize the HT electric connection in the name of respondents 3 and 4 at Pacifia Tech Park, No.23, Rajiv Gandhi Salai, (Old Mahabalipuram Road), Chennai-603 103.
ORDER
1. This Writ Petition is filed praying to issue a Writ of Mandamus, directing the first respondent to consider the representation dated 25.4.2012 made by the petitioner prior to issuing orders to energize the HT electric connection in the name of respondents 3 and 4 at Pacifia Tech Park, No.23, Rajiv Gandhi Salai, (Old Mahabalipuram Road), Chennai-603 103.
2. Mr.P.Gunaraj, learned counsel takes notice on behalf of the respondents 1 and 2. In view of the nature of order to be passed in this case, the notice to the respondents 3 to 5 is dispensed with. By consent, the writ petition is taken up for final disposal.
3. Petitioner has grievance against the respondents 3 to 5 and has made a representation on 25.4.2012 to the first respondent.
4. Learned counsel for the respondents 1 and 2 states that the first respondent will consider the representation of the petitioner as may be directed by this court and the claim of respondents 3 to 5 on merits.
5. In view of the nature of relief sought for and the submission made by the learned counsel for the respondents 1 and 2, the first respondent is directed to consider the representation dated 25.4.2012 and dispose the same after affording opportunity to the respondents 3 to 5, in accordance with law so as to avoid allegation of violation of principles of natural justice. It is made clear that this court has not expressed any opinion on petitioner claim. The authority is at liberty to consider the claim of the petitioner only on merits.
6. The Writ Petition is disposed of as above. No costs.
