Heard learned counsel for the petitioner and learned A.P.P. for The petitioner has been made accused for the offence under

the Prosecution. Sections 147, 148, 149, 307, 353, 414, 332, 504 of the Indian Penal Code, Sections 3, 4 of the Explosive Substance Act, Section 17(ii) of the C.L.A. Act and Sections 38, 39 and 40 of the Law Against but Conversation (Prohibited). in connection with Bero P.S. Case No. 52 of 2008 corresponding to G.R. No. 3296 of 2008. From the F.I.R., it appears that there was heavy exchange of fire between the police party and extremists group, in which, there was injuries and causality in the side of the extremists group. It appears that there is no causality or injury amongst the police party and extremists fled away. Heavy arms and ammunitions were also recovered. Learned counsel for the petitioner has submitted that the petitioner is not named in the F.I.R. and he has been made accused only on the basis of confessional statement of co-accused.
