Full Judgment
1. Shri R.S. Chaturvedi, learned counsel for the petitioner. Shri Kumaresh Pathak, learned Deputy Advocate General for the respondents.
2. Heard on the question of admission.
3. In the instant petition filed as a public interest litigation grievances agitated by the petitioner are that he is an agriculturist and a member of Deendayal Antyodaya Samiti, Gram Panchayat Tendua, Janpad Panchayat, Gangeo, District, Rewa. The Government of India launched a scheme, namely, Nirmal Gram Purushkar in order to promote sanitation coverage to ensure better health and quality of life of the people in rural areas. For proper implementation the Government of India has floated an incentive scheme for sanitisation and open defecation of Gram Panchayats, Blocks and Districts. For receiving the award every Gram Panchayat while applying for Purushkar was required to declare that all households in the Panchayati Raj Institution (PRI) are having toilets which are in use and the practice of open defecation, dry latrines and manual scavenging have been fully eliminated. The Gram Panchayat, Tendua Kothar applied for the same by furnishing requisite declaration. The respondents on due inspection and verification awarded the Nirmal Gram Purushkar to Gram Panchayat Tendua Kothar. It is submitted by the learned counsel for the petitioner that this Purushkar was obtained by the Gram Panchayat by furnishing wrong declaration that the amount sanctioned by the Government in that regard was misappropriated by the respondents; that no toilet has been constructed in households of the Gram Panchayat nor any reward amount has been provided to the villagers; and that despite several representations made by the villagers to the authorities concerned, 1the same has fallen in deaf ears and nothing has been done in order to fulfill the requirements as prescribed for Nirmal Gram Purushkar.
4. The petitioner, therefore, has prayed for conducting necessary investigation by some independent authorities.
5. Learned Deputy Advocate General fairly stated that the Collector, Rewa (respondent No.2) shall conduct an enquiry and take appropriate steps in the matter. In the event the petitioner makes a detailed complaint supported with necessary materials along with a copy of the instant writ petition before the respondent No.2, the same shall be dealt with in stricto sensu.
6. We, therefore, dispose of this petition at this stage with the direction to the Collector, Rewa, respondent No.2, to look into the grievance of the petitioner and hold proper enquiry regarding the allegations and thereafter take suitable decision in accordance with law expeditiously, preferably within a period of six months.
7. With the above order the instant writ petition stands finally disposed of.
