III For the Ranchi University: Mr. Anoop Kumar Mehta For the JPSC: Mr. Rajesh Shankar Mr. Abhay Prakash 3/16.12.2015: In these writ applications, petitioners had prayed for issuance of a direction commanding the respondents to consider their case for promotion from the post of Lecturer to the post of Reader under the various statutes of the Universities. It is submitted that the petitioners' services have been regularized on the recommendation of Justice S.C. Agrawal Commission and after regularization, they have completed more than 10 years in regular service. Thus, as per the statutes of the Universities, the petitioners are entitled to be promoted from the post of Lecturer to the post of Reader either on merit-cum-seniority basis or under the time bound promotion scheme. Accordingly, it is submitted 9 that a direction may be issued commanding the respondents to consider the case of the petitioners for promotion. Learned counsel for the Universities submits that if the petitioners files applications in proper format along with requisite documents, then their cases will be considered for promotion by the Universities. If they will be found fit for promotion, then the University forward their cases to the Jharkhand Public Service Commission (JPSC). Learned counsel for the Jharkhand Public Service Commission submits that as and when the cases of the petitioners will be recommended to the JPSC along with requisite documents, their cases will be considered by the JPSC and if any petitioner will be found suitable, the formal order will be passed in accordance with law. In view of the aforesaid submissions at bar, I direct each of the petitioner to file separate application in prescribed format along with requisite documents before the respective Universities as per the statute. If such applications are filed, the University Authorities are directed to consider the same and pass order in accordance with law. If any matter recommended to the JPSC, the JPSC shall also consider the same and pass order in accordance with law.
