examination - primary teachers training examination--entitlement of students to appear--petitioners completed training from respective college which was recognised by state--jharkhand secondary examination board not allowed those students to appear in forthcoming primary teachers training examination--since students of others similar situated institution had been allowed to appear in said examination--no further order required to be issued in three cases. - motor vehicles act, 1988[c.a.no.59/1988] section 166; [a.k. patnaik, cj, a.k. gohil & s. samvatsar, jj] application for compensation for personal injury death of injured claimant subsequently for some other reasons held, claim for personal injury will abate on the death of claimant. claim will not survive to his legal representative except as regards claim for pecuniary loss to estate of claimant.orders.j. mukhopadhaya, j.1. in all these cases as one of the common prayer is to allow the petitioners to appear in the forthcoming primary teachers training examination, they were heard together and are being disposed of by this common order.2. the petitioners claim that they have completed teachers training examination from respective colleges as recognised by the state but it is alleged that the jharkhand secondary examination board, ranch hadnot allowed the students of their respective colleges to appear in forthcoming primary teachers training examination in respect to which notice no. 41 of 2002 was issued in terms of court's order passed in another case.3. the respondents were allowed time in w.p.(c) no. 361 of 2002 to obtain instruction and file counter affidavit. an affidavit has been filed today enclosing copy of a decision taken by the state and communicated to the administrator, jharkhand secondary school examination board. ranchi vide letter no. 78 dated 17th january, 2002.4. mr. kalyan rai, learned counsel for the board submitted that the students who completed teachers training from the colleges, named in the enclosure attached to letter dated 17th january. 2002 for the session 1997-98 to 2000-2001 shall be allowed to appear in the forthcoming teachers training examination. the board has taken decision to act as per the direction of the state given by the letter dated 17th january. 2002.5. from the enclosure letter dated 17th january. 2002 it appears that the students of number of training colleges completed training during the session 1997-98. 1998-99, 1999-2000 and 2000-2001 have been allowed to appear in the forthcoming primary teachers training examination. it includes primary teachers training college. ranchi, primary teachers training college, chakulia, primary teachers training college, birsal, government teachers training college, hazaribagh, primary girls teachers training cullege. daltonganj, primary teachers training college, simaria......
