The learned counsel submits that this writ petition may be disposed of with liberty to the petitioner to approach the Circle Officer by filing proper application and the Circle Officer may be directed to take a decision on the application of the petitioner. The learned counsel for the respondents has no objection if such a direction is issued to the Circle Officer. Accordingly, the writ petition is disposed of with liberty to the petitioner to submit a fresh application before the Circle Officer within a period of six weeks and the Circle Officer is directed to make enquiry in the matter and pass appropriate order, in accordance with law and the order be communicated to the petitioner. Serial No. 12650, the benefit under the Scheme has yet not been provided to the petitioner and therefore, a direction may be given to the respondent-State for providing benefit of B.P.L. scheme to the petitioner. The learned counsel appearing for the respondent-State of Jharkhand does not deny that the parentage of the petitioner was initially wrongly indicated which however, has been corrected and the same is reflected in the enquiry report, a copy of which is annexed at page 20 with the counter-affidavit. It is submitted that if the petitioner is entitled for benefit, the same would be provided to the petitioner. Considering the facts and circumstances of the case, this writ petition is disposed of. In view of the counter-affidavit filed on behalf of the respondent-State of Jharkhand a direction is issued to the respondent no. 3 to consider the claim of the petitioner for grant of benefit under the B.P.L.
