.....on 23.03.2020, the court on the same day passed the following: :-2-:orderthis is an application for bail filed under section 439 cr.p.c.2. the petitioner herein is the sole accused in crimeno.200 of 2020 of the irinjalakuda police station for the offences punishable under sections 353, 294(b) of the indian penal code and section 117(e) of the kerala police act.3. the prosecution case in brief is that on 29.2.2020 at about17.15 hours at irinjalakuda private bus stand, while the de facto complainant along with other officers were on 'pink' patrolling duty, accused abused them with obscene words and caused obstruction to their official duty.4. heard the learned counsel for the petitioner and the learned public prosecutor.5. the accused was arrested and produced before the learned judicial first class magistrate court, irinjalakuda on 1.3.2020 and he has been in judicial custody since then.6. considering the fact that the accused has been in judicial custody since 1.3.2020, this is a fit case for granting bail to the petitioner on the following grounds:- :-3-:7. in the result, the petition is allowed and it is ordered as follows. the petitioner shall be released on bail on the following conditions:-i) the petitioner shall execute a bond for rs.25,000/- (rupees twenty five thousand only) with two solvent sureties each for the like amount to the satisfaction of the magistrate's court concerned. ii) the petitioner shall appear before the investigating officer as and when required. iii) if the petitioner violates any of the conditions of bail, it is open to the court having jurisdiction over the case to cancel his bail without any further orders from this court but in accordance with law. sd/- n.anil kumar, judge mbs/

ORDER

This is an application for bail filed under Section 439 Cr.P.C.

2. The petitioner herein is the sole accused in Crime

No.200 of 2020 of the Irinjalakuda Police Station for the offences punishable under Sections 353, 294(b) of the Indian Penal Code and Section 117(e) of the Kerala Police Act.

3. The prosecution case in brief is that on 29.2.2020 at about

17.15 hours at Irinjalakuda private bus stand, while the de facto complainant along with other officers were on 'pink' patrolling duty, accused abused them with obscene words and caused obstruction to their official duty.

4. Heard the learned counsel for the petitioner and the learned Public Prosecutor.

5. The accused was arrested and produced before the learned Judicial First Class Magistrate Court, Irinjalakuda on 1.3.2020 and he has been in judicial custody since then.

6. Considering the fact that the accused has been in judicial custody since 1.3.2020, this is a fit case for granting bail to the petitioner on the following grounds:- :-3-:

7. In the result, the petition is allowed and it is ordered as follows. The petitioner shall be released on bail on the following conditions:-

i) The petitioner shall execute a bond for Rs.25,000/- (Rupees Twenty Five thousand only) with two solvent sureties each for the like amount to the satisfaction of the Magistrate's court concerned. ii) The petitioner shall appear before the Investigating Officer as and when required. iii) If the petitioner violates any of the conditions of bail, it is open to the court having jurisdiction over the case to cancel his bail without any further orders from this Court but in accordance with law.
