Dated this the 23rd day of March 2020 Application for regular bail.
2. The petitioner is the accused in Crime No. 631 of 2019 of Aloor Police Station registered for the offences punishable under Sections 457, 461, 511 of 380 of the Indian Penal Code.
3. The petitioner has been in custody since 30.01.2020.
4. The prosecution allegation is that on
28.11.2019 the petitioner has broke open the door of the ATM counter of SBI situated at Kuzhikattussery junction and attempted to commit theft. Thereby the petitioner has committed the aforesaid offences.
5. According to the learned counsel for the petitioner, the petitioner is absolutely innocent.
6. The learned Public Prosecutor has opposed the application pointing out the criminal antecedents of the petitioner.
7. Heard both sides.
8. Of course, this petitioner has criminal
antecedents. But he is not involved in any other theft case. Considering the period of detention undergone by him in custody, the other facts involved, and the present stage of investigation, I am inclined to release him on bail. Therefore, this application is allowed subject to the following conditions:
(i) The petitioner shall be released on bail on his
executing a bond for a sum of Rs.50,000/- (Rupees fifty thousand only) with two solvent sureties for the like sum each to the satisfaction of the court having jurisdiction.
(ii) The petitioner shall appear before the Investigating Officer for interrogation as and when required by him, in writing.
(iii) The petitioner shall not leave the jurisdiction of Aloor Police Station without the prior permission of the jurisdictional Magistrate.
(iv) The petitioner shall not directly or
indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or to any police officer or tamper with the evidence.
(v) The petitioner shall not commit any offence while on bail. In case of violation of any of the above conditions, the learned Magistrate is empowered to cancel the bail in accordance with the law. Sd/- SHIRCY V. JUDGE sb
