ORDER

The writ petition has been filed seeking writ of Certiorarified Mandamus to call for the records pertaining to the order bearing No. 3634/Tha.Ku.2/2026 dated 19.06.2026 passed by the 1st respondent and quash the same and consecutively direct the respondents to grant emergency leave for 6 days without escort to the detenue Subburaj S/o./Subbukutti, aged about 39 years, PID No.21378, detained at Central Prison, Palayamkottai.

2. Mr.S.Manoharan, learned counsel for the petitioner would

submit that the petitioner hails from a poor background and the petitioner's brother who has been detained in the prison as a convict prisoner has been Page No.2 of 6 granted emergency leave with escort. Due to the poor financial status, they are unable to pay for the fees of escorts and thereby, the present petition has been filed seeking to permit the petitioner to go on leave without escort.

3. Mr.D.Venkatesh, learned Counsel for the State of Tamil

Nadu (Crl. Side) appearing for the respondents would submit that the petitioner is going on leave for the first time and thereby he has been directed to go along with escort. However, he would submit the conduct of the prisoner is good. 4.Heard the learned counsel on either side and perused the materials available on record.

5. Taking into consideration that the sister of the convict

prisoner is suffering from serious ill health and also considering the poor financial status and family circumstances of the petitioner, we are inclined to grant emergency leave to the convict prisoner without escort, on the following conditions: Page No.3 of 6

(i) The convict prisoner namely, Subburaj, S/o.Subbukutti, (PID No.21378) now detained in the Central Prison, Palayamkottai, is granted emergency leave for six days from 06.07.2026 to 11.07.2026 without escort

(ii) The convict prisoner shall be released from the prison at 7.00 a.m on 06.07.2026 and he shall surrender before the prison authority on 12.07.2026 before 10.00 a.m.,

(iii) The convict prisoner shall appear before the 3rd respondent police daily at 06.30 p.m., without fail.

(iii) During the leave period, the convict prisoner shall abide by all the conditions prescribed in the Jail Manual.

6. With the above direction, the Writ Petition stands allowed.

No costs. Consequently, connected miscellaneous petition is closed.
