ORDER

This Petition is filed to condone the delay of 210 days in filing the second appeal against the judgment and decree passed by the Learned Principal Subordinate Judge, Palani (Camp Court at Kodaikanal) in AS No.121 of 2018 dated 12.09.2023 confirming the judgment and decree passed by the learned District Munsif cum Judicial Magistrate, Kodaikanal in OS No.112 of 2007 dated 28.06.2018.

2.The learned counsel for the petitioner would submit that due to his ill health, he was unable to prefer an appeal in time and hence, the delay has been occurred. 3.The learned counsel for the respondent raised his objections.

4.In view thereof, this Court gives one more opportunity to the petitioner. Accordingly this Court is inclined to allow the said application on payment of cost of Rs.3,000/-. Accordingly, this Petition is allowed on payment of cost of Rs.3,000/- (Rupees Three Thousand only) to the learned counsel for the respondent within a week from today. On such
