JUDGMENT

The above writ petition is filed with the following prayers; “ i) Issue a writ in the nature of mandamus or any other appropriate writ, order or direction commanding the 2nd respondent to permit the petitioner to pay the dues as per Exts. P2 and P3 Demand Notices in a phased manner in the interest of justice.

ii) Issue any such other appropriate writ, order

or direction as this Hon’ble Court deems fit and proper considering the circumstances of the case in the interest of justice.” (SIC)

2. The petitioner suffered Ext.P1 award from the

Motor Accidents Claims Tribunal, Kozhikode. As per Ext.P1 the 2nd respondent is directed to pay the compensation amount and there is an order allowing recovery of the same from the petitioner. The petitioner admit the entire liability. The petitioner submits that the amount due is Rs. 5,23,694/-. The petitioner submits that, two of his children are physically disabled. The petitioner also submits that he is a coolie worker and residing along with his mother and family. The petitioner is facing stringent financial crisis. The recovery is now initiated against the residential property of the petitioner. Hence, the petitioner seeks 18 installments to clear the entire amount due.

3. Heard the learned Counsel for the petitioner, the learned Standing Counsel appearing for the 2 nd respondent. The learned Government Pleader takes notice for 1 st respondent.

4. After hearing both sides, I think the prayer in this writ petition itself can be allowed. Petitioner is allowed to pay the entire amount due in installments.

5. Therefore, this writ petition is disposed of with the following directions;

1. The petitioner is allowed to pay the entire amount due as per Exts. P1 to P3 in 18 equal monthly installments starting from 15.11.2022.

2. If there is any default of two consecutive

installments, the respondents are free to proceed in accordance to law.
