ORAL ORDER
1. Accused no.2 in Crime No.15/2026 registered by Hebbal
Police Station, Bengaluru City, for the offences punishable under Sections 22(b) of the NDPS Act, 1985, is before this Court under Section 483 of BNSS, 2023, seeking regular bail.
2. Heard the learned Counsel for the parties.
3. FIR in Crime No.15/2026 was registered by Hebbal Police
Station, Bengaluru City, for the aforesaid offences against unknown persons based on the first information dated 20.01.2026 received from Ganjendra - Police Officer attached to Hebbal Police Station. In the said case, petitioner herein was arrested on 20.01.2026 and subsequently remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl. Misc. No.1278/2026 was rejected on 13.02.2026. Therefore, petitioner is before this Court.
4. Perusal of the first information would go to show that
based on the credible information received by the first informant on 20.01.2026 at 14.15 hours that some persons -3- were making attempts to sell contraband article within the jurisdiction of Hebbal Police Station, he had submitted first information and thereafter a raid was conducted at the alleged spot where the accused were attempting to sell the contraband article and had apprehended three persons by name Syed Alfas, Sandeep Kumar and Mohammed Saif. From the possession of Syed Alfas (accused no.1), 15 grams of contraband article allegedly MDMA was recovered and from the possession of Sandeep Kumar (accused no.2) and Mohammed Saif (accused no.3), contraband article allegedly MDMA weighing 3 grams each, was recovered and seized under a panchanama.
5. Accused no.3 from whom contraband article MDMA
weighing 3 grams was seized in the present case has been granted regular bail by the coordinate bench of this Court in Crl.P.No.3438/2026 disposed of on 09.04.2026. The allegation against the petitioner and accused no.3 who has been granted regular bail in Crl.P.No.3438/2026 is similar. Learned Counsel for the petitioner has submitted that petitioner has no other criminal antecedents. The seized contraband article from the -4- petitioner is of intermediate quantity. Under the circumstances, I am of the opinion that petitioner's prayer for grant of regular bail is required to be answered affirmatively. Accordingly, the following order:
6. The Criminal petition is allowed. The petitioner is directed
to be enlarged on bail in Crime No.15/2026 registered by Hebbal Police Station, Bengaluru City, for the offences punishable under Sections 22(b) of the NDPS Act, 1985, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; -5- e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
