.....of mv act, against thejudgment and award dt.30.01.2020 passed in mvcno.639/2019 on the file of the iii additional district judge, mact, mysuru, partly allowing the claim petition for compensation and seeking enhancement of compensation. this appeal, coming on for orders, this day,judgment was delivered therein as under:coram: hon'ble mr. justice jayant banerji &hon'ble ms. justice tara vitasta ganjuoral judgment(per: hon'ble mr. justice jayant banerji) despite the matter being called twice, no one appears for the appellant. when the matter was last listed on 04.06.2026, the following order was passed:“learned counsel for the appellant prays for and is granted two weeks’ time to file duly attested translated copies of the documents/depositions on record supported by an affidavit as required under order xiii rule 12 of cpc (karnataka amendment) failing which the appeal shall stand dismissed without further reference to the court. if the translations are filed, list on 23.06.2026.”2. the office report is that the affidavit (as requiredby order dated 04.06.2026) is yet to be filed. moreover, we note from the trial court record that though various depositions require translation, however the translated -3- deposition of only pw-2 has been filed. therefore, we dismiss this appeal for non-prosecution. “Learned Counsel for the appellant prays for and is granted two weeks’ time to file duly attested translated copies of the documents/depositions on record supported by an affidavit as required under Order XIII Rule 12 of CPC (Karnataka Amendment) failing which the appeal shall stand dismissed without further reference to the Court. If the translations are filed, list on 23.06.2026.”

Moreover, we note from the Trial Court Record that though various depositions require translation, however the translated -3- deposition of only PW-2 has been filed.
