JUDGMENT

The writ petition has been filed challenging Ext.P12 order passed by the 4 th respondent directing the petitioner to demolish certain construction carried out by him in his property. It is contended by the petitioner that Ext.P12 order has been passed without hearing him.

2. Heard the learned counsel for the petitioner, the learned Standing Counsel for respondents 1 and 2 and also the learned counsel for the 3rd respondent.

3. It is submitted by the learned counsel for

the petitioner that when the matter was posted before the Ombudsman, though the petitioner tried to join through on-line, he could not join due to some technical snag.

4. Since Ext.P12 order has been passed

without hearing the petitioner, the same is set aside and the 4th respondent is directed to pass fresh orders after hearing the petitioner, the Municipality and the 3rd respondent. Till fresh orders are passed by the Ombudsman, the structure already constructed by the petitioner shall not be demolished. However, it is made clear that the petitioner shall not carry out any further construction till fresh orders are passed by the Ombudsman. The Ombudsman may endeavour to pass orders as above within a period of six weeks from the date of receipt of a copy of this

judgment.
