-------------------------------- W.P.(C).No.3041 of 2006 ---------------------------------------------- Dated this the 15th day of November, 2022
JUDGMENT
This writ petition is filed with following prayers: i. Issue a writ of certiorari or any other appropriate writ or direction to the respondents calling for the records leading to Ext.P4 and P5 and quash the same. ii. Grant such other reliefs which this Honourable Court may deem fit and proper in the circumstances of the case. (SIC)
2. Petitioner challenge Exts.P4 and P5 issued by the Kerala State Electricity Board (KSEB).
3. Heard the learned counsel for the petitioner and the learned Standing Counsel for KSEB.
4. When this writ petition came up for consideration on 01.02.2006, this Court passed the following order: “Notice. There will be interim stay as prayed for, for a period of five months, on condition that the petitioner deposits an amount of Rs.30,000/- within a period of three weeks.”
5. The interim order was extended until further orders
on 11.08.2006. Ext.P1 is a bill issued by KSEB without a provisional bill. The petitioner approached the 2 nd respondent. The 2nd respondent passed Ext.P4 order and issued Ext.P5 modified short assessment bill. According to the petitioner, Ext.P4 order is passed without considering the contentions raised by the petitioner. The counsel for the petitioner submitted that if an opportunity is given, he will be able to substantiate the same before the 2nd respondent.
6. This writ petition is filed in the year 2006 and the
same is pending before this Court for the last 16 years. Since the petitioner has got a grievance that proper opportunity is not given, I think Exts.P4 and P5 can be set aside and there can be a direction to the 2nd respondent to reconsider the matter. Therefore, this writ petition is allowed in the following manner:
1. Exts.P4 and P5 are set aside.
2. The 2nd respondent is directed to
reconsider the matter, after affording an opportunity of hearing to the petitioner.
