Learned Mediator has submitted a report along with the copy of the agreement reached between the parties. The agreement has been executed on behalf of all three plaintiffs by Mr.B.Gnana Sambandham, General Manager Legal and Statutory. A partner of the defendant has signed the agreement on behalf of the defendant.

2. In the settlement agreement, the defendant has admitted that the first

plaintiff is the registered proprietor of the trade mark AACHI and that the second and third plaintiffs are licensees. It is also agreed that the defendant may continue to use the trade marks mentioned at recital C in respect of the restaurant in Coimbatore, Tamil Nadu. Parties have also agreed to maintain a minimum distance of one kilometre between the first two restaurants to be established by the rival parties as per terms indicated in recital D. I find no legal impediment to the issuance of a decree in terms of the memorandum of compromise.

3. Therefore, C.S.(Comm.Div.) No.217 of 2025 is decreed in terms of

memorandum of compromise dated 23.01.2026, which shall form an integral part of the decree. In view of the settlement, there will be no order as to costs. Consequently, the connected applications are closed. 23-02-2026 Index: Yes/No
