(Order of the Court was made by R.Suresh Kumar J.) The present petitioners were temporarily appointed as Data Entry Operators on a consolidated pay, and they claimed to have been working for some years. Subsequently, not only the present petitioners but also the main writ appellants, who are the private respondents in this petition are also similarly placed persons, since they were also appointed like the present petitioners, had been terminated.

2. Challenging the termination order those writ petitioners, who are the

appellants herein had earlier filed writ petition unsuccessfully, therefore, they preferred the present writ appeal, hence this present writ appeal. Page8 of 12

3. Insofar as the present petitioners are concerned, they never agitate the

issue challenging the termination order in the manner known to law and if at all they have any grievance over the termination order, they should have agitated the issue in the manner known to law. They cannot seek for an impleadment that too at the appeal stage in the present appeal as respondents. Therefore, the present petition is liable to be dismissed for the aforestated reason and accordingly, it is dismissed. No costs. However, dismissal of this petition would not preclude the present petitioners to agitate the issue if they are advised to do so in the manner known to law by initiating fresh litigation. (R.S.K.,J.)
