Writ Petition has been filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the 2 nd respondent to issue Community Certificate to the petitioner’s daughters’ (N.Boomika and N.Akshaya) and son (Kuraleswaran) based on mother’s origin. ORDER
(Order of the Court was made by Dr.G.Jayachandran, J.) The writ petition is filed by the mother of N.Boomika, N.Akshaya and Kuraleswaran seeking issuance of a Writ of Mandamus directing the 2 nd respondent to issue Community Certificates to her two daughters by name N.Boomika and N.Akshaya and one son, by name N.Kuraleswaran based upon her community status and origin.
2. The petitioner is a native of Puducherry. According to the petitioner,
her father and her ancestors were all indigenous residents of Puducherry prior to 05.03.1964. As contemplated under the Constitution (Puducherry Scheduled Castes) Order, 1964, she belongs to the Hindu Adi-Dravidar Community by origin, which is recognised as a Scheduled Castes under the said Presidential
Order.
3.The petitioner submits that when she approached the second respondent seeking issuance/renewal of the Community Certificates, she was orally informed that certain issues relating to the grant of Community Certificates based on the mother’s nativity are pending consideration before the Hon’ble Supreme Court of India. Therefore, Community Certificates cannot be issued on the basis of the mother’s nativity alone. Hence, the present Writ Petition has been filed for the aforesaid prayer.
4. The learned Additional Government Pleader representing Puducherry
of Government submitted that the application made by the petitioner is under consideration, in the light of the Presidential Order dated 05.03.1964; the subsequent Circulars and Official Memorandums issued from time to time. Based on the Judicial Pronouncements rendered sofar, necessary decision will be taken on her application in accordance with law.
5. Recording the submissions made by the learned Additional
Government Pleader, this Writ Petition is disposed of with a direction to the 2 nd respondent to consider the application of the petitioner dated 02.06.2026 and pass appropriate speaking order, on merits and in accordance with law, within a period of eight weeks, from the date of receipt of a copy of this order.
