ORDER
Petitioner is the first accused in Crime No.16/2022 of Info Park Police Station alleging commission of offences under Sections 22(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985.
2. The allegation against the petitioner is that, the petitioner was found in possession of 3.410 grams of MDMA and thereby he committed the offences alleged against him.
3. Learned counsel for the petitioner submits that the
petitioner is absolutely innocent in the matter. It is submitted that the petitioner has been falsely implicated in the matter and that there was no recovery of contraband from the petitioner. It is submitted that the petitioner has been in custody from 07.01.2022 and has completed 56 days in custody as on date. It is submitted that since the final report has not been filed in the matter, the petitioner is entitled to statutory bail on completion of 60 days in custody.
4. Learned Public Prosecutor vehemently opposes the
grant of bail. The circumstances appearing against the petitioner are pointed out from the record and it is submitted that the petitioner is accused of having committed a serious offence and is not entitled to be released on bail. However, it is submitted that no criminal antecedents are reported against the petitioner.
5. Having regard to the facts and circumstances of the case
and considering the fact that the petitioner would be entitled to statutory bail on completion of 60 days in custody (if final report is not filed) and considering the fact that the petitioner has been in custody for 56 days, I am of the opinion that the petitioner can be granted bail subject to conditions. I also note that the learned Public Prosecutor upon instructions, submitted that the filing of the final report will take some more time as the chemical analysis report is not yet received.
6. In the result this bail application is allowed. It is directed that the petitioner shall be released on bail, subject to the following conditions:-
(i) The petitioner shall execute a bond for a sum of Rs.50,000/- (Rupees fifty thousand only) with two solvent sureties each for the like sum to the satisfaction of the jurisdictional Court;
(ii) The petitioner shall appear before the investigating officer in Crime No.16/2022 of Info Park Police Station as and when called upon to do so.
(iii) The petitioner shall not attempt to interfere with the investigation, influence or intimidate any witness in Crime No.16/2022 of Info Park Police Station;
(iv) The petitioner shall not involve in any other crime
while on bail. If any of the aforesaid conditions are violated, the Investigating officer in Crime No.16/2022 of Info Park Police Station may file an application before the jurisdictional Court for cancellation of bail.
