JUDGMENT
Dated this the 17th day of January, 2022 The petitioner, whose family owns Paravur Sree Subrahmanya Swami Temple, Paravur P.O., Punnapra, Alappuzha, has filed this writ petition seeking to stay the Special General Body Meeting proposed to be held on 16.01.2022 convened as per Ext.P6 notice dated 29.12.2021 by the 4th respondent, who is a stranger to the property in the Final Decree in O.S.No.244/1994.
2. The petitioner submits that he was the Managing
Trustee of the Paravur Sree Subrahmanya Swami Temple. The said Temple is situated in their family property. There was a Partition Suit and a final decree was passed on 06.03.2015 in O.S.No.244/1994 of Sub Court, Alappuzha.
3. Now, the 4th respondent, who is not a member of
the family and who is not a party to the O.S., is trying to convene a General Body Meeting of the Trust. The 4 th respondent has no business to convene such a meeting since he is not a member of the family and he is not a party to the decree in the Civil Court. Therefore, the petitioner prays that this Court may pass orders staying the Special General Body Meeting proposed to be held on 16.01.2022.
4. I have heard the learned counsel for the petitioner and the learned Government Pleader representing the 1 st respondent.
5. The issue agitated by the petitioner is one relating
to a private family Temple. There is nothing on record to show that it is a Temple having the character of a public Temple. When issue matter relates to a dispute regarding a private family Temple, writ jurisdiction of this Court under Article 226 of the Constitution of India cannot be invoked.
