Dated this the 25th day of January, 2022 This Crl.M.C. has been filed to quash the proceedings in CC No.96/2020 on the file of JFCM-II, Palakkad. The petitioners are the accused Nos.1 to 3. The 3rd respondent is the de facto complainant. The offence alleged are under Sections 498A and 406 r/w 34 of IPC.

2. I have heard Sri.P.T.Mohan Kumar, the learned counsel for the petitioners, Smt.M.K.Pushpalatha, the learned Public Prosecutor and Sri.P.K.Mohanan, the learned counsel for the 3 rd respondent.

3. Having heard the learned counsel for the petitioners as

well as the 3rd respondent, I am of the view that this Crl.M.C. can be disposed of giving liberty to the petitioners to file an application for discharge before the learned Magistrate. The learned Magistrate shall dispose of the said application, if any filed, in accordance with law. The petitioners are free to take up all the pleas raised in this Crl.M.C. before the learned Magistrate -:4:- in the application for discharge.
