ORDER

The petitioner is the accused in C.C.No.3393/2013 pending on the file of the Judicial First Class Magistrate Court, Irinjalakkuda. The offences alleged against the petitioner are under Sections 498A and 406 IPC.

2. The non-bailable warrant is pending against the

petitioner. The learned counsel for the petitioner submits that the petitioner was in Gulf and he has come over to India this morning. The counsel further submits that the petitioner is prepared to surrender before the learned Magistrate, but he apprehends that on surrender he would be remanded and his bail application would not be considered on the same day. The limited prayer of the petitioner is to give a direction to the learned Magistrate to consider his bail application on the very Crl.M.C. No.142 of 2022 3 same day. In the result, this Crl.M.C is disposed of with a direction to the learned Magistrate to consider the bail application, if any, filed on surrender of the petitioner, on the very same day itself, in accordance with law.
