JUDGMENT

K.Vinod Chandran, J.

The petitioners in the above original petitions are husband and wife and the subject matter is restoration of the respective O.A's, dismissed by the Tribunal for default. There was also delay of 649 days in filing the petition for restoration, both of which stood dismissed by the learned Tribunal. The contentions are similar, in so far as, the husband and wife were abroad and the husband not being able to get leave to prosecute the O.A, and file application for restoration. The learned Tribunal after due consideration rejected the applications on the ground of no sufficient cause having been shown to condone the delay, no substantiation having been made with respect to the grounds urged and the divergent stand taken by the power holder, who was examined as PW 1, before the Tribunal.

2. Both the O.As stood dismissed for default, on 17.8.2017 for

reason of the learned counsel appearing for the applicants having submitted no instructions, especially since the applicants having - 4 - not turned up, even after issuance of a registered notice. PW 1 is the father of the petitioner in O.A. 1 of 2020 and the father-in-law of the petitioner in O.A. 2 of 2020. According to PW 1, immediately on dismisal of the O.A. on 17.8.2017, the fact was intimated to his son and daughter.
