JUDGMENT

Originally, this petition has been filed by the petitioner under Article 227 of the Constitution of India, seeking direction to the court below to consider an application filed by the petitioner under Section 10 of C.P.C in O.S 1631/2019.

2. Though notice served on the respondent, nobody appeared.

Now, the learned counsel for the petitioner would fairly submit that both suits are pending before the same court and in order to avoid conflicting judgments in relation to same subject matter between the same parties where issue levelled is one and the same, joint trial if ordered, the grievance of the petitioner will be addressed. Going by the nature of contentions in the case, I am inclined to allow the prayer as canvassed. Therefore, the O.P is allowed, thereby the Additional Munsiff Court, Thiruvananthapuam is directed to jointly try O.S Nos.1631/2019 and 1886/2018 and decide the matter in issue in accordance with law within a period of four months from reopening of the summer vacation.
