ORDER

Petitioner is one among the accused in Crime No.886 of 2019 of Eravipuram Police Station, Kollam district alleging commission of offences under Section 143, 147, 148, 341, 294(b), 323, 324, 308, 149 of the IPC.

2. The allegation against the petitioner is that he along

with the other accused attacked the defacto complainant and inflicted injuries on him and thereby they committed the offence alleged against them. When this matter was taken up for consideration today, it is a submission of the learned Public Prosecutor that an absconding charge sheet has been filed in so far as it relates to the petitioner as the petitioner had not appeared in the matter.

3. The learned counsel for the petitioner submits that the petitioner was working abroad and this was the sole reason why the petitioner could not appear.

4. Considering the above, I deem it appropriate to dispose

of this bail application directing that if the petitioner surrenders before the jurisdictional court on or before 26.02.2022, any bail application filed by him shall be considered and disposed of on the same day having regard to the judgment of the Supreme Court in Aman Preet Singh V. CBI through Director; [2021(6)KHC 54].
