This Civil Miscellaneous Petition has been filed to condone the delay of 972 days in filing the above appeal.

2. Heard the learned counsel for the petitioner and the learned counsel for the 2nd respondent.

3. The learned counsel for the 2nd respondent has no serious objection to allowing the application.

4. The petitioner would aver that, due to the death of her husband in a road

traffic accident that took place on 01.07.2022, she had to take care of her minor daughters and meet the day-to-day expenses of the family. She would further aver that, owing to financial constraints, a delay of 972 days has occurred in preferring the Civil Miscellaneous Appeal.

5. Accepting the averments made by the petitioner in the affidavit enclosed

with the petition, this Court is inclined to allow this Civil Miscellaneous Petition subject to the condition that the interest for the delay period of 972 days alone shall stand waived. Accordingly, this Civil Miscellaneous Petition is ordered. nvi Page No.1 / 2 nvi Page No.2 / 2
