.....with cr.no.52 of 2026.2. heard the learned counsel appearing for the petitioners and the learned additional public prosecutor for respondents 1 and 2 and perused the materials on record. heard the3. the case of the prosecution is that the defacto complaint, along withhis friends were sitting in a snacks bar. at that time, the petitioners entered the premises, abused, assaulted and chased away the defacto complainant. the petitioners also called the defacto complainant by caste name in public place. hence, a case in crime no.52 of 2006 has been registered against the petitioners for the offences under sections 296(b), 115(2), 126(2), 351(2), of bns, 2023 and 3(1)(r), 3(1)(s), 3(2)(va) of the scheduled castes and scheduled tribes (prevention of attrocities) act.4. the learned additional public prosecutor submitted that the first petitioner is a history sheeter in h.s.no.3 of 2026 and the petitioners 2 and 3 are his associates. page2 of 55. the learned counsel for the petitioners submitted that the petitioners are innocent and they have been falsely implicated in this case. he further submitted that the case is a counter case.6. in view of the above factual position, there shall be a direction tothe principal district and sessions judge for sc/st cases, chengalpattu district to consider the petitioners’ bail application, preferably on the same day of their surrender, in connection with crime no.52 of 2026 on the file of the second respondent police and to pass appropriate orders in accordance with law, after affording due opportunity to the victims under section 15-a of the sc/st(poa) act, 1989. the petitioners shall surrender before the jurisdictional court concerned within a period of fifteen days from the date of the receipt of a copy of this order.7. the criminal original petition stands disposed of accordingly. 09-04-2026 index: yes/nospeaking/non-speaking orderneutral citation: yes/no pvs page3 of 5 to1. the state rep by its the deputy superintendent.....

ORDER

This Criminal Original Petition has been filed seeking a direction to the learned Principal District and Sessions Judge for SC/ST Cases, Chengalpattu District, to consider the petitioners’ bail application, preferably on the same day of their surrender, in connection with Cr.No.52 of 2026.

2. Heard the learned counsel appearing for the petitioners and the learned Additional Public Prosecutor for respondents 1 and 2 and perused the materials on record. Heard the

his friends were sitting in a snacks bar. At that time, the petitioners entered the premises, abused, assaulted and chased away the defacto complainant. The petitioners also called the defacto complainant by caste name in public place. Hence, a case in Crime No.52 of 2006 has been registered against the petitioners for the offences under Sections 296(b), 115(2), 126(2), 351(2), of BNS, 2023 and 3(1)(r), 3(1)(s), 3(2)(va) of the Scheduled Castes and Scheduled Tribes (Prevention of Attrocities) Act.

4. The learned Additional Public Prosecutor submitted that the first petitioner is a History Sheeter in H.S.No.3 of 2026 and the petitioners 2 and 3 are his associates. Page2 of 5

5. The learned counsel for the petitioners submitted that the petitioners are innocent and they have been falsely implicated in this case. He further submitted that the case is a counter case.

6. In view of the above factual position, there shall be a direction to

the Principal District and Sessions Judge for SC/ST Cases, Chengalpattu District to consider the petitioners’ bail application, preferably on the same day of their surrender, in connection with Crime No.52 of 2026 on the file of the second respondent Police and to pass appropriate orders in accordance with law, after affording due opportunity to the victims under Section 15-A of the SC/ST

(PoA) Act, 1989. The petitioners shall surrender before the jurisdictional Court concerned within a period of fifteen days from the date of the receipt of a copy of this order.
