COMMON ORDER

Since the issue involved in these writ petitions are one and same, these writ petitions are heard together and disposed of by way of this common order.

2. By consent of both parties, these writ petitions are taken up for final disposal at the admission stage itself.

3. These writ petitions have been filed for a direction, directing the 1st and 2nd respondent to consider and pass orders on the petitioner's representations dated 21.01.2026 & 27.12.2025 respectively in accordance with law.

4. It is the case of the petitioners that the petitioner is a society registered

under the Tamil Nadu Cooperative Society Act. The object of the society is lending loan to the teachers of the Government School as well as Government Aided School. The fifth respondent in the respective writ petitions had availed loan for a sum of Rs.5 lakhs on 23.12.2009, for which the sixth respondent in respective writ petitions stood as guarantor. The Deputy Registrar initiated proceedings under Section 90 which ultimately led to passing of awards against the petitioners. The awards were also communicated to the petitioners. Thereafter, they filed execution proceedings and approached the respondents seeking enforcement of award by making representations dated 21.01.2026 & 27.12.2025 respectively, however, no action is taken. Hence, these writ petitions.

5. The learned counsel for the petitioner submitted that the debtors/5 th

respondent in both cases are due to retire on 30.09.2026 and 30.06.2026, the amount payable to the petitioner society is public money, therefore, seeks for a direction to settle the loan amount to the petitioner society.

6. The learned Special Government Pleader submitted that the second

respondent Chief Educational Officer will conduct enquiry by hearing the petitioner, respondents 5 and 6 in both writ petitions and will pass appropriate orders within a reasonable time as fixed by this Court.

7. Heard the learned counsel for the petitioner and the learned Special Government Pleader and perused the materials placed on record.

8. Considering the limited relief sought for in this writ petition, this Court

without going into the merits of the case directs the second respondent, Chief Educational Officer to consider the representations of the petitioners dated 21.01.2026 & 27.12.2025 respectively and pass appropriate orders on merits and in accordance with law after conducting enquiry by hearing the petitioner society, respondents 5 and 6 in both the petitions. Such exercise shall be completed within a period of six weeks.

9. Accordingly, these writ petitions stand disposed of. No costs. 08-04-2026 dhk Index:Yes/No
