.....nadu public premises (eviction of unauthorized occupants) act. 2.the learned senior counsel mrs.chitra sampath appearing forthe writ petitioner would submit that in response to the impugned orderdated 17.07.2013, the petitioner has already submitted his explanation along with the documents to establish that notice has been issued in respect of the property belongs to the petitioner. 3.in view of the above factum, it is imminent that an enquiry is to be conducted by the estate officer to adjudicate the facts and thereafter, form an opinion and pass appropriate orders to complete the enforcement actions by following the procedures as contemplated under the act andrules. the petitioner may be provided with the personal hearing in orderto establish his case before the estate officer. the estate officer, being a quasi judicial authority, is empowered to conduct personal hearing and take appropriate decision. 4.in view of the facts and circumstances, the 2nd respondent is directed to conduct an enquiry by providing a personal hearing to the petitioner and thereafter, pass appropriate final orders on merits and in accordance with law. the said exercise is directed to be completed within a period of twelve(12) weeks from the date of receipt of a copy of thisorder.5.with the above directions, this writ petition stands disposed of. no costs. consequently, connected wmp is also closed. (Order of the Court was made by S.M.Subramaniam J.) The writ on hand has been instituted challenging the eviction proceedings initiated by the Estate Officer under Tamil Nadu Public Premises (Eviction of Unauthorized Occupants) Act. 2.The learned Senior Counsel Mrs.Chitra Sampath appearing for

the writ petitioner would submit that in response to the impugned order

dated 17.07.2013, the petitioner has already submitted his explanation along with the documents to establish that notice has been issued in respect of the property belongs to the petitioner. 3.In view of the above factum, it is imminent that an enquiry is to be conducted by the Estate Officer to adjudicate the facts and thereafter, form an opinion and pass appropriate orders to complete the enforcement actions by following the procedures as contemplated under the Act and

Rules. The petitioner may be provided with the personal hearing in order

to establish his case before the Estate Officer. The Estate Officer, being a quasi judicial Authority, is empowered to conduct personal hearing and take appropriate decision. 4.In view of the facts and circumstances, the 2nd respondent is directed to conduct an enquiry by providing a personal hearing to the petitioner and thereafter, pass appropriate final orders on merits and in accordance with law. The said exercise is directed to be completed within a period of twelve(12) weeks from the date of receipt of a copy of this

order.
