ORDER
This Criminal Miscellaneous Petition has been filed seeking relaxation of condition 8 (ii) imposed by this Court vide order dated 07.01.2026 in Crl.A.No.1961 of 2025.
2. It is submitted by the learned counsel for the
petitioner/appellant that this Court, while allowing the appeal in Crl.A.No.1961 of 2025, vide order dated 07.01.2026, imposed a condition directing the petitioner/appellant to reside at Trichy and report before the Trichy Contonment Police Station, everyday at 10.30 a.m., except on the hearing dates before the trial Court. It is further submitted that the petitioner/appellant has been complying with the said condition from 07.01.2026 without fail and that he is the sole bread winner of his family and has to take care of his aged parents. Hence, he prayed to relax the said condition.
3. Learned Government Advocate (Criminal Side) appearing for respondents 1 and 2 submitted that the petitioner/appellant has been regularly complying with the conditions imposed by this Court.
4. Having heard the learned counsel appearing on either side and
upon perusal of the materials available on record and also taking note of the reasons adduced in the affidavit filed in support of this petition, this Court is inclined to relax condition 8 (ii) imposed by this Court.
5. Accordingly, condition 8(ii) imposed by this Court in Crl.A.No.1961 of 2025 dated 07.01.2026 is relaxed. However, the petitioner/appellant shall appear before the trial Court on all hearing dates without fail.
