ORDER
This Criminal Original Petition has been filed to direct the 1st respondent to register the FIR by following the order in Crl.MP.No.2282 of 2023 dated 19.03.2024 passed by the learned District Munsif Cum Judicial Magistrate, Karimangalam, within a time frame fixed by this Court.
2. The primary contention of the learned counsel for the petitioner is that,
despite the order dated 19.03.2024 made in Crl.M.P.No.2282 of 2023 passed by the learned District Munsif cum Judicial Magistrate, Karimangalam, directing the respondent police/Station House Officer, Karimangalam to investigate the matter as per law, register an FIR against the 2 nd respondent and produce a compliance report before the Court concerned forthwith, till date, no FIR has been registered. Hence, the present petition.
3. Mr.Leonard Arul Joseph Selvam, learned Additional Public Prosecutor appearing for the first respondent filed a counter submitted that pursuant to the
order dated 19.03.2024 made in Crl.M.P.No.2282 of 2023 passed by the learned
District Munsif cum Judicial Magistrate, Karimangalam, the respondent police conducted an enquiry with the petitioner and the counter petitioner. However, the counter petitioner did not appear and co-operate with the enquiry. He fairly admitted that there was some delay on the part of the respondent police to register the FIR and submitted that now the FIR has been registered in Karimangalam Police Station in Crime No.124 of 2026 for the offence under Sections 420, and 465 IPC and that the appropriate action will be taken against the offender without any further delay.
4. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the first respondent and perused the materials available on record.
5. In view of the above submission made by the learned Additional Public
Prosecutor for the first respondent, this Court directs the 1st respondent/police to investigate the matter and file a final report in this case, within a period of six
(6) months from the date of receipt of a copy of this order.
