(Judgment of the Court was delivered by C.Kumarappan J.) The present Writ Appeal has been filed, assailing the order of the learned Single Judge dated 11.04.2022 made in W.P.No.29405 of 2013. Page1 of 4

3. Mr.R.Ramanlal, learned Additional Advocate General assisted
by Mr.C.Gauthama Raj, learned Standing Counsel for the appellant would fairly submit that though the appellant has no serious objection in dismissal of the writ petition, learned Single Judge, while confirming dismissal of the approval petition, passed orders beyond the scope of writ petition in respect of granting DCRG benefits and family pension. He would further submit that DCRG amount had already been paid and that no family pension scheme is available, since Contributory Pension Scheme came to be implemented by the Appellant Corporation with effect from 01.04.2003. Thus, contended that the question of payment of family pension does not arise at all.
4. In view of the above fair submission made by the learned
Additional Advocate General and also on the fact that the family pension scheme was substituted by Contributory Pension Scheme since 01.04.2003, we are of the view that the direction issued by the learned Single Judge in respect of family pension is incorrect and beyond the scope of writ petition. Thus, the said direction alone is liable to be set aside. Accordingly, the present Writ Appeal is disposed of as indicated above. No costs. Consequently, connected Miscellaneous Petition is closed.
