ORDER

This Criminal Original Petition has been filed to call for the records relating to the order dated 29.01.2026 made in Crl. MP. No. 556 of 2026 in Crime No.224 of 2025 on the file of the learned Metropolitan Magistrate Exclusive Trial of CCB and CBCID Cases, Egmore, Chennai and to modify custody/return of the property upon execution of a simple bond, without insisting upon the said onerous condition.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

3. Considering the submissions and on perusal of the materials available

on record, it is seen that the petitioner is the HR Manager of M/s. Aditya Infrastructure Private Limited. Earlier, in his capacity as HR Manager, the petitioner lodged a complaint against Saravanan, former Chief Operating Officer of M/s. Aditya Infrastructure Pvt. Ltd., alleging misappropriation, cheating and falsification of accounts to the tune of Rs.15 crores. The case has been registered in Crime No.224 of 2025 on 18.12.2025 for the offences under Sections 409, 420, 477A and 506(1) IPC. During the course of investigation, the laptop and the company car bearing Registration No.TN 09 CL 2040 (BMW

Page2 of 4 520D SLWAT BS IV), which was retained by the said Saravanan, were seized by the police.

4. The petitioner filed a petition for return of property in Crl.M.P.No.556

of 2026. The trial Court granted interim custody of the car to the petitioner. However, one of the conditions imposed was that the petitioner should execute a bond for Rs.50,00,000/- with one surety for a like sum. Against the said condition, the present petition has been filed.

5. It is not is dispute that the car stands in the name of M/s.Aditya

Infrastructure Pvt., Ltd., who is also the complainant in Crime No.224 of 2025, and the same has been seized in connection with the said crime. For return of the complainant’s vehicle, imposing such a condition is not appropriate and is onerous.

6. In view of the above, this Court set aside condition No.5 imposed in

Crl. MP. No. 556 of 2026 in Crime No.224 of 202 dated 29.01.2026. The petitioner is directed to execute a bond for Rs.10,00,000/- and upon such execution, the car shall be returned to the petitioner.
