ORDER
This Writ Petition has been filed to direct the respondents not to enter into the petitioner’s land morefully disclosed in the prayer to this writ petition for the purpose of fencing the petitioner’s land measuring an extent of 0.94.00 ares, based on the representations given by the petitioner, which includes the last representation dated 26.02.2026.
2. Ms.Sushma, learned Senior Panel Counsel, accepts notice on behalf of the respondents.
3. The petitioner’s grievance is that the respondents are attempting to
encroach upon the petitioner’s agricultural land by putting up a fencing on the petitioner’s land. He had given representations to the respondents requesting them not to enter into the petitioner’s land and not to put up any fencing on the petitioner’s land. According to the petitioner, the representations of the petitioner, which includes the last representation, dated 26.02.2026 have not been considered by the respondents. In such circumstances, the petitioner has filed this writ petition. Page No.2 of 4
4. No prejudice would be caused to the respondents, if the petitioner’s
last representation as stated supra is considered on merits and in accordance with law, after giving due consideration to the supporting documents produced by the petitioner, within a time frame to be fixed by this Court. This Court is not expressing any opinion on the merits of the petitioner’s last representation.
5. For the foregoing reasons, this Court directs the 1 st respondent to pass
final orders on merits and in accordance with law on the petitioner’s last representation, dated 26.02.2026 requesting the respondents not to enter upon the petitioner’s land morefully disclosed in the prayer to this writ petition and requesting them not to put up any fencing on the petitioner’s land, after giving due consideration to the supporting documents filed by the petitioner, within a period of twelve (12) weeks from the date of receipt of a copy of this order.
6. With the aforesaid direction, this Writ Petition is disposed of. No costs. Consequently, the connected miscellaneous petition is closed. Index : Yes / No
