ORDER
This Writ Petition has been filed to direct the 3rd respondent to implement its order, dated 15.07.2025 for closure of the 4 th respondent welding company, since it is located in a residential area.
2. The petitioner had given a representation to the 3 rd respondent on 05.01.2026 for the aforesaid purpose. Since the same has not been considered, the petitioner has filed this writ petition. Page No.2 of 6
3. Mr.K.Surendran, learned Additional Government Pleader,
accepts notice on behalf of the 1 st respondent, Mr.V.Gunasekar, learned Standing Counsel, accepts notice on behalf of the 2 nd respondent, Mr.Tippu Sulthan, learned Government Advocate, accepts notice on behalf of the 3rd respondent. Since no adverse order is passed against the 4th respondent in this writ petition, notice to the 4th respondent is dispensed with by this Court.
4. No prejudice would be caused to the respondents, if the
petitioner’s representation as stated supra is considered on merits and in accordance with law, after hearing the objections of the 4 th respondent as well as any other party, whom the 3rd respondent deems it fit to enquire, and after giving due consideration to the order of the 3 rd respondent dated 15.07.2025, which the petitioner seeks to implement, within a time frame to be fixed by this Court. This Court is not expressing any opinion on the merits of the petitioner’s representation.
5. For the foregoing reasons, this Court directs the 3rd respondent
to pass final orders, on merits and in accordance with law, on the Page No.3 of 6 petitioner’s representation, dated 05.01.2026 seeking for closure of the 4th respondent’s welding company in terms of the order dated 15.07.2025 passed by the 3rd respondent, after hearing the objections, if any, from the 4th respondent as well as any other third party, whom the 3rd respondent deems it fit to enquire, within a period of twelve (12) weeks from the date of receipt of a copy of this order.
6. With the aforesaid direction, this Writ Petition is disposed of. No costs. 13.03.2026 Index : Yes / No
